1. Service Description and Scope
AES-Filing.com, operated by AES-Filing.com (BorderTek Solutions), provides AES/EEI (Automated Export System / Electronic Export Information) filing preparation, review, and submission assistance for U.S. exporters and licensed customs brokers.
Our service includes: Preparation of AES/EEI filing documentation based on information provided by the user; electronic submission of completed filings to the Automated Export System maintained by the U.S. Census Bureau; issuance of Internal Transaction Numbers (ITNs) for approved filings; and general guidance on export compliance requirements and AES filing procedures.
AES-Filing.com is a division of BorderTek Solutions. Unless you have specifically engaged us for freight forwarding services under a separate agreement, we are not acting as your freight forwarder. Our scope is limited to AES/EEI filing preparation and submission on your behalf.
The exporter or authorized representative remains solely and fully responsible for the accuracy, completeness, and truthfulness of all information submitted in the AES filing.
2. User Responsibilities and Export Control Compliance
By using AES-Filing.com, you represent and warrant that:
- Accuracy of Information: All information you provide regarding the shipment, goods, destination, value, and parties involved is accurate, complete, and truthful. You understand that false or misleading information submitted in an AES filing constitutes a violation of federal law.
- Legal Authority: You have the full legal authority to export the goods and to authorize AES-Filing.com to submit the filing on your behalf. If acting on behalf of another party, you represent that you possess a valid power of attorney or written authorization.
- Compliance with Export Laws: The transaction and goods comply with all applicable U.S. export laws and regulations, including the Export Administration Regulations (EAR) (15 CFR Parts 730–774), the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120–130), Office of Foreign Assets Control (OFAC) sanctions and embargo regulations (31 CFR Parts 500–598), and U.S. Customs and Border Protection (CBP) regulations (19 CFR).
- Prohibited End-Uses: The goods are not intended for a prohibited end-use, including weapons of mass destruction, military applications without proper authorization, or other end-uses forbidden under U.S. export law.
- Denied Parties Screening: You have conducted appropriate screening of all transaction parties against the OFAC Specially Designated Nationals List, the Commerce Department's Entity List, and the State Department's Debarred List, and no such party appears on any restricted party list.
You acknowledge that false or inaccurate AES filings constitute violations of 15 CFR Part 30 and may result in civil penalties of up to $14,800 USD per violation, criminal penalties including fines and imprisonment, seizure of goods, and administrative remedies.
3. Filing Accuracy and Limitation of Liability
AES-Filing.com will exercise reasonable professional care in preparing your AES/EEI filing based on the information you provide. We will review filings for obvious errors, formatting compliance, and adherence to CBP and Census Bureau requirements.
AES-Filing.com is not liable for errors, inaccuracies, omissions, or misstatements in your filing that result from information you provided or failed to provide. If you provide incorrect shipment value, Harmonized Tariff Schedule codes, destination country, or party information, you are solely responsible for any consequences including CBP rejections, penalties, or delays.
AES-Filing.com is not liable for CBP rejections, customs hold-ups, delays, examinations, duties or fees assessed by CBP, missed vessel deadlines or transportation delays, or any actions or inactions by CBP, the Census Bureau, or other government agencies.
Cap on Liability: Our total liability to you for any claim arising from your use of our service is limited to the fees you paid for the specific filing in question. This limitation applies to all claims regardless of cause, including negligence, breach of contract, or violation of law. AES-Filing.com provides services “as is” without warranty that filings will be accepted or exports will proceed without delay.
4. Turnaround Time and Deadlines
Standard turnaround times are outlined on our pricing page. Turnaround is measured from the time we receive complete and accurate information from you.
We are not responsible for missed vessel deadlines or carrier cutoffs if submission of shipment information was made less than 24 hours before the required AES filing window. The 72-hour pre-departure requirement for vessel exports is the exporter's responsibility to plan for.

5. Payment Terms
Fees are due at the time of service or per any separately agreed billing arrangement. All fees are stated on our pricing page or in your service agreement.
No Refunds: No refunds will be issued once an EEI has been submitted to and accepted by CBP. If a filing is rejected due to an error on our part, we will correct and resubmit at no additional charge.
Disputed charges must be raised in writing within 30 days of the invoice date. Undisputed charges not paid within terms may accrue late fees.
6. Confidentiality
We treat all shipment data, business information, and customer details as confidential. We do not share your information with third parties except as required to perform the filing service (CBP, AESDirect, Census Bureau) or as required by law.
Data shared with our third-party email delivery provider, Google reCAPTCHA, and Google Analytics is subject to those providers' respective privacy policies. See our Privacy Policy for details.
7. Export Control Compliance
Our service may not be used to file AES for shipments destined for OFAC-sanctioned countries or for goods subject to export license requirements that have not been properly obtained. We reserve the right to refuse service for any shipment we believe may violate U.S. export control laws, without refund of fees paid if a violation is suspected.
If your shipment may require a BIS, DDTC, or other export license, see our licensed exports service before proceeding.
8. Intellectual Property
All content, tools, templates, and materials on aes-filing.com are owned by AES-Filing.com (BorderTek Solutions). Users may not scrape, copy, reproduce, or distribute site content without prior written permission. Unauthorized use may result in legal action.
9. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from or related to these Terms or your use of our service that cannot be resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Florida. Both parties waive the right to participate in class action litigation or class-wide arbitration.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date, and we will provide at least 30 days' notice before changes take effect where reasonably possible. Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms.
